These general terms and conditions apply to all competitions, prize draws, giveaways and promotions (each, a "Competition") run by Simone Pérèle Pty Ltd (ABN 87 007 320 461) of 263 Brunswick Road, Brunswick VIC 3056 (the "Organiser", "we", "us", "our"), whether conducted on our website, by email, or via our social media channels.

Each Competition may also have specific terms (such as the entry period, entry method and prize), which will be published with that Competition. The specific terms form part of these terms for that Competition and prevail to the extent of any inconsistency. Entering a Competition constitutes acceptance of these terms and any applicable specific terms.

1. Eligibility

Entry is open to individuals who are residents of Australia and New Zealand and aged 18 years or over at the time of entry.

Employees (and their immediate families) of the Organiser, its related entities, and any agency or partner associated with the Competition are not eligible to enter.

Participation is personal and, unless the specific terms state otherwise, limited to one entry per person. We reserve the right to verify the eligibility and identity of any entrant and to require proof of identity and residency. We may disqualify any entrant who tampers with the entry process, submits an entry that is not in accordance with these terms, or engages in conduct that is fraudulent, misleading or otherwise unlawful. Incomplete, indecipherable, fraudulent or non-compliant entries will be deemed invalid.

2. Winner Selection and Notification

Unless the specific terms state otherwise, the winner will be determined by [random draw / judging by the Organiser, whose decision is final]. Any invalid or incomplete entries drawn will be disregarded and a redraw conducted where required.

The winner will be notified using the contact details associated with their entry (for example by email, or by social media direct message) within 5 business days of the draw. The winner must respond and provide any required details within 14 days of notification. If a winner cannot be contacted, does not respond within this period, or is found to be ineligible, they forfeit the prize and we may, subject to any applicable law or permit conditions, conduct a redraw or select an alternative winner. We may be required to publish or make available the winner's name (and, where relevant, suburb/state) in accordance with applicable laws or permit conditions. By entering, you consent to this and to the Organiser using your name for this purpose without further notice or compensation.

4. The Prize

The prize is as described in the specific terms. The prize value is determined at the time of publication and is not negotiable.

Unless expressly stated, the prize:

• is non-transferable, non-exchangeable and not redeemable for cash or credit;
• does not include any costs not specifically listed (for example flights, transfers, visas, passports, travel insurance, meals, beverages or other personal expenses); and
• must be taken as offered, subject to any conditions, blackout dates or booking requirements set by the Organiser or any prize provider.

If a prize (or any element of it) becomes unavailable for reasons beyond our reasonable control, we may substitute it with a prize of equal or greater value, subject to any applicable law or permit conditions. We are not responsible for any prize that is lost, stolen, damaged or delayed in transit once dispatched. Where a prize is supplied by a third party (for example a travel, accommodation or experience partner), the prize is subject to that provider's own terms and conditions, which the winner must accept. We are not responsible for the acts, omissions or default of any third-party prize provider.

5. Social Media Competitions

Where a Competition is run on social media, it is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, Meta, TikTok, or any other platform. By entering, you release these platforms from any liability and acknowledge that you are providing your information to the Organiser and not to the platform. Each Competition is also subject to the relevant platform's own rules.

6. Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Subject to the above, and to the fullest extent permitted by law, the Organiser (and its related entities, employees and agents) is not liable for any loss, damage, cost, expense or injury (including indirect or consequential loss) suffered or sustained in connection with a Competition, an entry, or the acceptance, use or enjoyment of a prize. This includes any loss arising from any technical fault, malfunction, delay, or failure of any network, system, software or hardware affecting entry or administration of a Competition.

7. Privacy

We collect entrants' personal information to conduct and administer Competitions, including to determine eligibility, notify and verify winners, and (where applicable) publish winners' details. Personal information is handled in accordance with our [Privacy Policy](insert link). We may need to disclose entrants' details to third parties such as regulatory authorities or prize providers in order to conduct a Competition. If you do not provide the information requested, we may be unable to accept your entry or award a prize.

8. General

The Organiser reserves the right to amend, suspend or cancel a Competition, or these terms, at any time due to circumstances beyond its reasonable control, or where the Competition is not capable of being conducted as reasonably anticipated, subject to any applicable law or permit conditions. No compensation will be payable in these circumstances. If any provision of these terms is found to be invalid or unenforceable, it will be read down or severed without affecting the remaining provisions. These terms are governed by the laws of the State of Victoria, Australia, and entrants submit to the non-exclusive jurisdiction of the courts of that State.
