In an effort to enhance your shopping experience and give as many customers as possible the opportunity to purchase our merchandise, we may place limits on purchases and we do not authorize the purchase of commercial quantities of our merchandise. We also may, among other things, restrict orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit, cancel or prohibit orders that, in our judgment, appear to be placed in violation of this policy. We further reserve the right to cease doing business with customers who violate this policy. We may modify this policy at any time without prior notice. You may not sell or resell any of the products, services, content or samples you purchase or otherwise receive from the Site. We reserve the right, with or without notice, to cancel, limit or reduce the quantity of any orders that we believe, in our sole discretion, may result in the violation of our Terms and Conditions.

Simone Perele attempts to be as accurate as possible when describing products on the Site; however, to the extent permitted by applicable law, we do not warrant that the product descriptions, colors or other content are accurate, complete, reliable, current, or error-free.

All of this Site’s design, text, graphics, logos, button icons, images, audio clips, data, information, illustrations, charts, indices, reports, data, HTML code and screens, the selection and arrangement thereof, and all software on this Site is owned by or licensed to Simone Perele, its affiliates, partners or licensors, and is subject to protection and international intellectual property laws, including, but not limited to, rights in the nature of patent rights, copyrights, trade secrets, trade names, trademarks, service marks, moral rights, know-how and any other similar rights recognized under laws or international conventions in any country or jurisdiction in the world.

You represent, warrant and covenant that (a) you have the power and authority to enter into this agreement; (b) you are at least eighteen (18) years old; and (c) your use of the Site will comply with Terms and Conditions.

DEFINITIONS

“Anniversary” means the exact date that a Member joined – recurring every year.

“Day” means a 24 hour period ending at 11.59pm AEDT

“Effective Date” means 1st October 2025

“Join Date” means the date a Member joins the Simone Loyalty Rewards Program.

“Member” means individuals who sign up to the Simone Loyalty Rewards Program.

“Member Emails” means emails that are sent from Simone Pérèle to a Member including emails about the individual’s membership, the Simone Loyalty Rewards Program, special offers, discounts, competitions and events.

“Member Profile” means the personal details of the Member.

“Member Terms and Conditions" means these terms and conditions as amended from time to time.

“Rewards” means rewards or other benefits given to Members as a consequence of purchasing behaviors, incentives and/or promotions.

“Simone Pérèle '' means Simon Perele Pty Ltd ABN 87 007 320 461, its related entities and its authorised representatives.

“Simone Rewards Program” means the loyalty program operated by Simone Pérèle providing Members with access to Rewards in accordance with these Member Terms and Conditions.

“Technical Issues” means the technical malfunction of any telephone network, connection or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.

“Valid Purchases” means all purchases except gift cards, delivery costs, and selected merchandise which Simone Pérèle determines will not be eligible to earn Rewards. Any purchases which are returned will not constitute Valid Purchases.

“Website” refers to the Simone Pérèle website www.simone-perele.com.au where details of the Simone Loyalty Rewards Program (including the most up to date Terms and Conditions) can be found and where Members can monitor their Member status and Member Profile.

NEW ZEALAND

NZ customers will earn points in Australia dollars, not NZ dollars charged by their bank.

MEMBER TERMS AND CONDITIONS

Individuals who join the Simone Rewards Program agree to be bound by these Member Terms and Conditions.

"Simone Rewards" Program are subject to the provisions of the Simone Pérèle Returns Policy, Privacy Policy and Competition Terms (as amended from time to time).

"Simone Rewards" Terms and Conditions may be modified at any time without prior notification by Simone Pérèle in its absolute discretion. Any modification to the Member Terms and Conditions may be applied to a Member retrospectively.

Simone Pérèle will not accept any liability for any Member Email that is misdirected, lost or not received.

Simone Pérèle will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Simone Rewards Program.

Simone Pérèle may collect personal information from Members for the purpose of facilitating the "Simone Rewards" Program. Personal information will be handled in accordance with the Simone Pérèle Privacy Policy - https://www.simone-perele.com.au/terms-and-conditions.

Members’ personal information will not be shared, sold, rented or disclosed other than as described in the Privacy Policy. Members’ personal information will be stored on secure servers in controlled facilities within Australia and overseas, we take all reasonable steps to ensure Members’ personal information is secure at all times and cannot be accessed, used or disclosed by any unauthorised persons.

The security of personal information sent to us by electronic means or by post cannot be guaranteed, we cannot accept responsibility for misuse, loss or unauthorised access to Members’ personal information where the security of information is not within our control. If you suspect any misuse or loss of Members’ personal information, please contact Simone Pérèle immediately.

Members acknowledge and agree that if Members’ personal information is accessed overseas we are not obliged to take reasonable steps to ensure overseas recipients comply with the provisions of the Privacy Act 1988 and the Australian Privacy Principles which are contained in Schedule 1 of the Privacy Act 1988.

Simone Pérèle reserves the right to cancel, terminate, modify or suspend the Simone Rewards Program at its election, to reset Spend Balances at any time and without notice. Without limitation to the foregoing rights, Simone Pérèle reserves the right to transfer Members to such other loyalty program owned, operated, managed or administered by Simone Pérèle, its ‘related bodies corporates’ or ‘associated entities’ as those terms are defined in Corporations Act 2001 (Cth).

Simone Pérèle may, at any time and in its absolute discretion cancel, terminate, modify or suspend membership of the Simone Rewards Program or any aspect of it if Simone Pérèle believes that a Member has engaged in fraudulent or unlawful activity or failed to comply with these Terms and Conditions.

Simone Pérèle may, at any time and in its absolute discretion, require a Member to provide to Simone Pérèle proof of identification (in a form requested by Simone Pérèle) for Simone Pérèle to verify the authenticity of a Member’s membership and compliance with the Member Terms and Conditions. Failure to provide proof of identification may result in termination of a Member’s involvement in the Simone Rewards Program.

Subject to a Member’s rights under the Australian Consumer Law, Simone Pérèle will not be liable for any loss or damage whatsoever suffered by any person as a result of the cancellation, termination, modification or suspension of the Simone Rewards Program or any aspect of it, the payout of any Rewards, the resetting of any Spend Balances.

Simone Pérèle will not be liable for any tax liability incurred by a Member in connection with the Simone Rewards Program, including that incurred in the provision and/or utilisation of Rewards.

"Simone Rewards" Terms and Conditions are to be read in conjunction with any additional conditions associated with Rewards, including without limitation with the Website Terms and Conditions and other relevant Simone Pérèle policies and or terms and conditions.

Simone Pérèle’s decision in relation to all matters arising in relation to the "Simone Rewards" Program is final and binding.

Any failure or delay by Simone Pérèle in exercising its rights under these terms does not constitute a waiver of those rights. Any waiver by Simone Pérèle must be in writing and signed by an authorised officer of Simone Pérèle. Nothing in these Member Terms and Conditions is intended to contravene any applicable law. To the extent that any provisions in these Member Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Member Terms and Conditions.

These Terms and Conditions are governed by the laws of Victoria.

MEMBERSHIP ELIGIBILITY

The "Simone Rewards" Program (“Program”) is open to individuals residing in Australia and New Zealand. Membership is free of charge and limited to one account per person, identified by a unique email address.

To participate, Members must create an account using an unique email address through official website. Membership accounts that are suspected of misuse, fraudulent activity, or violation of these Terms may be suspended or terminated at the sole discretion of Simone Pérèle.

An individual becomes a Member of "Simone Rewards" on the Sign up Date.

It is the Member’s responsibility to ensure their Member Profile is up to date including their full name, email, mobile number, birthday, and postal address. If a Member has not provided or updated Simone Pérèle with correct details, Simone Pérèle may not be able to contact the Member about their membership, Rewards, special offers or entry to competitions. Rewards can only be allocated via a unique email address. Upon joining the "Simone Rewards" Program, a Member will be allocated to a "Simone Rewards" Program status tier on the basis of the transaction spend that qualified them to apply for membership.

At any time, Members can only have one account to the "Simone Rewards" Program per unique email.

Members may not transfer their account or Rewards to another person.

Simone Pérèle reserves the right to modify, refuse or terminate a Member’s account to the "Simone Rewards" Program without notice or reason and at its absolute discretion.

By joining the "Simone Rewards" Program, an individual consents to Simone Pérèle contacting them to provide them with consumer or marketing information and notifying them of Rewards or other products and special offers.

EARNING REWARDS AND POINTS

Members may earn Points through the following activities:

Make a Purchase: 1 Point per AUD $1 spent (excluding taxes, shipping, and discounts).
Sign Up: Receive a $10 Welcome Reward voucher upon joining.
Complete Your Profile: Earn 100 Points.
Celebrate Your Birthday: Earn 200–600 Points depending on your VIP tier (valid profile information required).
Follow Us on Instagram: 50 Points (once per account).
Follow Us on Facebook: 50 Points (once per account).
Leave a Product Review: 80 Points (once per product).
Download Your Digital Wallet Card: 50 Points (on initial download)
Refer a Friend: $10 off for both you and your friend upon a successful purchase by the referred customer.

Important Notes:

Birthday Rewards are issued during the Member’s birth month and require a complete profile to be eligible.
Social media and product review rewards may only be earned once per platform/account.
Referral rewards apply only to first-time purchases made by new customers using a Member’s unique referral link.

The "Simone Rewards" Program operates by attributing different Rewards (as nominated by Simone Pérèle from time to time) to the various tiers of the Simone Loyalty Rewards Program Silver, Gold and Platinum which are based on your annual spend.

Members are allocated to tiers on the basis of their Spend Balance since their anniversary.

Spend Balances are not transferable.

When a Member completes a transaction and logs into their member account either online or in-store, they will earn 1 point for every $1 spent which will be added to their loyalty member account on the day the transaction was made.

The currency in which Rewards are earned will be in AUD.

Simone Pérèle will notify the Member via email when the Member is entitled to a Reward or changes to a different tier within the "Simone Rewards" Program.

Simone Pérèle reserves the right to withdraw, cancel or vary the Rewards without notice and at any time for any reason whatsoever in its absolute discretion including without limitation Rewards awarded in error or to which the Member is not entitled or Rewards earned fraudulently.

Rewards cannot be sold, transferred or assigned and are not redeemable for cash or any gift vouchers, gift cards, cheques and credit notes. Rewards do not represent legal tender in any country.

If a Membership is terminated from the "Simone Rewards" Program, all outstanding and future Rewards will no longer be valid and will be rendered null and void.

When a Member returns a purchase in-store or via post, the net amount of the transaction and the reward points will be deducted from the Member's Spend Balance and the Points that were previously awarded will be adjusted or reversed.

If an online order is cancelled, Simone Pérèle may adjust or reverse points that were previously awarded to a Member in that transaction.

Tier rewards status resets annually on every anniversary date of when you originally joined, where you will revert to the previous tier for the next 12 months unless spent to the qualifying amount to reach the next tier.

TIERS AND ASSOCIATED REWARDS

Members are allocated to tiers on the basis of their Spend Balance (a Member's 'status') in the following manner:

Silver Member Status: Members whose Spend Balance is $0 - $699, including GST, within a 12 month period from the Anniversary Date.

Gold Member Status: Members whose Spend Balance is $700 - $1499, including GST, within a 12 month period from the Anniversary Date.

Platinum Member Status: Members whose Spend Balance is $1500 or more, including GST, within a 12 month period from the Anniversary Date.

A Member may move at any time to a higher loyalty tier in the "Simone Rewards" Program when that Member’s Spend Balance qualifies them to move to the higher tier.

On each Member’s Anniversary, a Member’s status will be determined by the Member’s Spend Balance and the Member will, depending on the Member’s Spend Balance, either retain their Member Status or be moved down to a previous tier. The Member’s status will then remain in that tier until the next Anniversary date unless the Member’s Spend Balance qualifies the Member to move to a higher tier.

All Valid Purchases will contribute to a Member’s Spend Balance.

SILVER STATUS

Members with ‘SILVER STATUS’ ’are eligible to receive the following Rewards:

Silver Tier Eligibility: To qualify as a Silver Member, a Member must accrue total Eligible Purchases valued between $0 and $699 within a twelve (12) month period, whether made in-store or online.

Welcome Reward: Upon successful enrolment into the Loyalty Program, new Members will be issued with a $10 Welcome Reward. This Reward will be provided in the form of a voucher, is valid for a single use only, and must be redeemed within thirty (30) days from the date of issue. The Welcome Reward is non-transferable, non-refundable, not redeemable for cash, and cannot be replaced if lost, stolen, or expired. Redemption is subject to a minimum purchase amount (where applicable), product availability, and the general terms and conditions of the Loyalty Program.

Birthday Reward: Eligible Silver Members will be entitled to receive 200 Loyalty Points once every twelve (12) months on the date of their registered birthday. To qualify, the Member must have provided a valid date of birth in their Member Profile no later than fourteen (14) days prior to the commencement of their birth month. The Birthday Reward will be credited directly to the Member’s loyalty account on their date of birth (i.e 25/02). Members will also receive a confirmation via email. Birthday Reward Points will automatically expire thirty (30) days from the date of issue and are not transferable, refundable, or redeemable for cash. Where a Member has accrued sufficient Points to redeem an eligible reward voucher, redemption may be made via online or at any Simone Pérèle flagship or outlet store. All redemptions are subject to availability and to the general terms and conditions of the Loyalty Program.

Double Point Promotion: Simone Pérèle may at its sole discretion, designate specific promotional periods as Double Point Days. During such periods, Members will earn Points at twice the standard accrual rate on eligible purchases, subject to the Loyalty Program Terms and Conditions. Members will be notified of Double Point Days via email or SMS. Participation is automatic upon making an eligible purchase during the promotional period. Double Point Days are time-limited and may vary in duration, exclusions, and conditions, all of which will be specified in the relevant promotional communication. Points earned through Double Point Days will be credited to the Member’s account in accordance with the standard processing timelines.

GOLD STATUS

Members with ‘GOLD STATUS’ ’are eligible to receive the following Rewards:

Gold Tier Eligibility: To qualify as a Gold Member, a Member must accrue total Eligible Purchases valued between $700 and $1,499 within a twelve (12) month period, whether made in-store or online. Upon entering the Gold Tier, Members will automatically receive a Gold Tier Entry Reward of 200 Loyalty Points, credited directly to their Member account. Tier Entry Rewards are issued once per qualifying period and are non-transferable, non-refundable, and not redeemable for cash.

Welcome Reward: Upon successful enrolment into the Loyalty Program, new Members will be issued with a $10 Welcome Reward. This Reward will be provided in the form of a voucher, is valid for a single use only, and must be redeemed within thirty (30) days from the date of issue. The Welcome Reward is non-transferable, non-refundable, not redeemable for cash, and cannot be replaced if lost, stolen, or expired. Redemption is subject to a minimum purchase amount (where applicable), product availability, and the general terms and conditions of the Loyalty Program.

Exclusive VIP Sale Access: Gold and Platinum Members will enjoy exclusive access to VIP Sales, available only to Members within these tiers. Such sales will be held at Simone Pérèle’s discretion and may vary in timing, duration, and offer details throughout the year. Eligible Members will be notified of upcoming VIP Sales promotions via email or SMS communications.

PLATINUM STATUS

Members with ‘PLATINUM STATUS’ ’are eligible to receive the following Rewards:

Platinum Tier Eligibility: To qualify as a Platinum Member, a Member must accrue total Eligible Purchases valued $1,500+ within a twelve (12) month period, whether made in-store or online. Upon entering the Platinum Tier, Members will automatically receive a Platinum Tier Entry Reward of 400 Loyalty Points, credited directly to their Member account. Tier Entry Rewards are issued once per qualifying period and are non-transferable, non-refundable, and not redeemable for cash.

Welcome Reward: Upon successful enrolment into the Loyalty Program, new Members will be issued with a $10 Welcome Reward. Birthday Reward: Eligible Gold Members will be entitled to receive 600 Loyalty Points once every twelve (12) months on the date of their registered birthday. To qualify, the Member must have provided a valid date of birth in their Member Profile no later than fourteen (14) days prior to the commencement of their birth month. The Birthday Reward will be credited directly to the Member’s loyalty account on their date of birth (i.e 25/02). Members will also receive a confirmation via email. Birthday Reward Points will automatically expire thirty (30) days from the date of issue and are not transferable, refundable, or redeemable for cash. Where a Member has accrued sufficient Points to redeem an eligible reward voucher, redemption may be made via online or at any Simone Pérèle flagship or outlet store. All redemptions are subject to availability and to the general terms and conditions of the Loyalty Program.

Double Point Promotion: Simone Pérèle may at its sole discretion, designate specific promotional periods as Double Point Days. During such periods, Members will earn Points at twice the standard accrual rate on eligible purchases, subject to the Loyalty Program Terms and Conditions. Members will be notified of Double Point Days via email or SMS. Participation is automatic upon making an eligible purchase during the promotional period. Double Point Days are time-limited and may vary in duration, exclusions, and conditions, all of which will be specified in the relevant promotional communication. Points earned through Double Point Days will be credited to the Member’s account in accordance with the standard processing timelines.

Exclusive VIP Sale Access: Gold and Platinum Members will enjoy exclusive access to VIP Sales, available only to Members within these tiers. Such sales will be held at Simone Pérèle’s discretion and may vary in timing, duration, and offer details throughout the year. Eligible Members will be notified of upcoming VIP Sales promotions via email or SMS communications.

POINTS REDEMPTION AND REWARD VOUCHERS

Reward Vouchers may be redeemed exclusively at Simone Pérèle flagship and outlet stores within Australia, or online at www.simone-perele.com.au.

Reward Vouchers are not valid for redemption through third-party retailers or stockists, including but not limited to David Jones and The Iconic.

Members may redeem accumulated Points for eligible Reward Vouchers, which can be applied toward purchases made online at simone-perele.com.au or at participating Simone Pérèle flagship and outlet stores. The following redemption values apply:

$10 Reward Voucher: 400 Points
$20 Reward Voucher: 600 Points
$30 Reward Voucher: 800 Points
$50 Reward Voucher: 1,100 Points

To redeem Points, Members must log into their Member Profile and select the desired Reward Voucher available based on their points accrued. Upon redemption, a confirmation email containing a unique voucher code will be issued. This code must be entered at online checkout to validate the Reward or presented in-store for application by a Simone Pérèle staff member.

Once Points have been redeemed for a Reward Voucher, the transaction is final. The redeemed Points will be deducted from the Member’s account and the Reward Voucher will be recorded in the Member’s account history. Reward Vouchers are single-use only, non-transferable, non-refundable, not redeemable for cash, and subject to the terms and conditions specified at the time of issue. Reward Vouchers may not be combined with other promotions, discounts, or offers unless expressly permitted by Simone Pérèle.

Points remain valid for twelve (12) months from the date they are earned. Points will automatically expire if not used within this period. In addition, if a Member’s account remains inactive (no earning or redemption activity) for over twelve (12) months, all accumulated Points will expire. Simone Pérèle accepts no responsibility for notifying Members of impending Points expiry.

Simone Pérèle will not be held responsible or liable if Rewards are not able to be redeemed for whatever reason but specifically, in the case of a Technical Issue including without limitation the failure of software or hardware or an EFTPOS malfunction.
